What Are The Different Kinds Of Arson?

Different types of arson include first-degree and second-degree arson. You may be charged with arson in the first degree if you start a fire or cause an explosion that intentionally damages:

  • Any property, including your own, where the fire puts someone in danger of physical harm or puts the protected property of another in danger of damage
  • Any property, including your own, where the fire causes a firefighter or peace officer to become injured in the line of duty

First-degree arson is a Class A felony. If convicted, you can face up to 20 years in prison and up to $375,000 in fines.

You may be charged with arson in the second degree if you start a fire or cause an explosion that intentionally damages:

  • Any building of another person that isn’t protected property
  • Any property of another person and the property damages are over $750

Second-degree arson is a Class C felony, and if you are convicted, you could face up to five years in prison and fines of up to $125,000.
