Form I-130

If you are a citizen of the United States residing in Oregon or southwest Washington, you have the opportunity to petition for an immediate family member to immigrate to the United States using Form I-130 – Petition for Alien Relative. An immediate family member would be a spouse, parent or unmarried child under 21 years of age. The Form I-130 petition is the first step to getting your loved one to the United States. Its purpose is to establish a familial relationship between the petitioner (U.S. citizen) and the petitioned (alien relative).

Without proof of an immediate familial relationship, immigration into the United States becomes exceedingly challenging and can take decades to finalize. If you need assistance with a Form I-130, contact immigration law attorney Robert Sepp today.

What You Need For A Form I-130

In order to successfully complete an I-130 visa petition, detailed information about the familial relationship is needed, including documented proof of the relationship. Acceptable proof of a familial relationship includes documentation such as birth and/or marriage certificates, bills/statements including both names of the spouses, photos, joint tax returns, joint bank accounts, etc.

What To Expect During The I-130 Petition Process

After your Form I-130 is accepted by the U.S. Citizenship and Immigration Services (USCIS), you can expect to hear from it within two to three weeks. On average, it takes anywhere from three to eight months for an I-130 visa petition to be approved. Upon approval of the Form I-130, the petitioned can then apply for legal permanent residency.
