What are your options after a conviction?

Understanding the legal options available after a conviction can be complex, and you might wonder how to challenge the conviction. Two possible options are direct appeals and post-conviction relief. But what is the difference between these options, and which one could benefit you more?

What is the right time to file: Direct appeals vs. Post-conviction relief?

Direct appeals happen right after conviction, while post-conviction relief can occur anytime after conviction. You must file a direct appeal within 30 days of the judgment, but you can file post-conviction relief anytime.

What is a direct appeal?

A direct appeal is a request for a higher court to look over the lower court’s decision in your case. You have 30 days to file your appeal notice after the judgment in your case. Some points to take note of are:

  • The appellate court reviews the record from the trial court to determine if any errors occurred during the trial that affected the outcome.
  • These errors might include improperly admitted evidence, incorrect jury instructions, or ineffective assistance of counsel.
  • You cannot introduce new evidence or arguments in a direct appeal.

A direct appeal focuses on correcting legal errors made during the trial.

What is post-conviction relief?

After a conviction is final, post-conviction relief involves a separate legal proceeding.

  • This path lets you challenge your conviction or sentence based on new factors.
  • You must file a petition for post-conviction relief within two years after your conviction is final as exceptions exist for specific time limits.
  • Post-conviction relief claims might allege that your constitutional rights were violated, new evidence appeared, or your trial attorney did not effectively help.

As a sanctuary city, Oregon is a haven for immigrants and refugees. However, any conviction can start proceedings to deport you or a loved one. Time is always essential in filing any relief and waiting makes it harder to gather evidence and build a case.
