Filing a post-conviction relief (PCR) petition can be complex as individuals seeking to overturn their convictions or sentences must navigate a web of laws and procedures. As someone considering filing a PCR petition, what challenges can you face? In addition, what steps can you take to overcome them?

Meeting the burden of proof

Meeting the burden of proof is a critical aspect of a PCR petition. As the petitioner, you must demonstrate that you are entitled to relief, which can be a difficult burden to meet. This requires a thorough understanding of the law and the ability to present a strong case.

Gathering evidence

Gathering evidence is a crucial step in meeting the burden of proof. You must collect and present new evidence that was not available during the trial. This can include DNA evidence, witness statements or other forms of proof that challenge the conviction or sentence.
